Claim Compensation for Cauda Equina Medical Negligence
A failure to identify compression of the cauda equina nerves can leave a patient with permanent disability and may justify a claim for compensation.
Compression of the cauda equina nerves
The cauda equina nerves are crucial to effective function of the bladder, bowel, genitals and lower limbs.
Any symptoms which might suggest that these nerves are being compressed by a herniated disc should be investigated as a matter of urgency. This appalling condition can sometimes be a medical emergency requiring surgery within hours.
Red flag symptoms of cauda equina syndrome
Red flag symptoms are those which should prompt an individual to go to their nearest Accident and Emergency facility as soon as possible. They should also prompt a referral for an emergency MRI scan by a medical professional.
The symptoms which might indicate that a patient is developing cauda equina syndrome would include the following:
- Symptoms such as pain and altered sensation in both legs rather than one leg, in addition to lower back pain
- Reduced or altered sensation in the saddle area, being the area between the legs and around the buttocks and genitals
- Reduced sensation of needing to urinate
- Altered sensation when urinating such as having to strain to empty the bladder
- Altered sensation around the anus or altered bowel function
The impact of medical negligence
If diagnosis and surgery are delayed, the patient may find that their compression worsens, their symptoms deteriorate and they are less likely to make any recovery.
This can leave a person dependent on a wheelchair and suffering with incontinence of both bladder and bowel.
This is not always the outcome but the earlier a diagnosis can be achieved, the better the long-term outcome for the patient is likely to be.
Medical failings such as a misdiagnosis, a failure of safety-netting or a delay in either arranging for an MRI scan or for surgery may all be regarded as substandard care.
If the patient suffers due to such a delay, it may be appropriate to make a claim for compensation.
