Cauda Equina Misdiagnosis and Claiming Compensation for the Disabling Consequences

Cauda Equina Misdiagnosis and Claiming Compensation for the Disabling ConsequencesA misdiagnosis of the symptoms of cauda equina compression can be both devastating and life-changing. If this has caused either you or a loved one to suffer permanent disability and reduced quality of life, contact Glynns Solicitors to discuss the possibility of making a claim for compensation.

Cauda equina compression and misdiagnosis

The cauda equina nerves in the lumbar region of the back are key to effective lower body function. Our safe mobility, control of the passing of wind and faeces, and sexual function all rely on these crucial nerves.

If these nerves become compressed or squashed, their ability to function may be reduced and the individual's levels of sensation and function in the lower body may be increasingly compromised.

Without prompt diagnosis and surgery, the die may be cast and the patient may become permanently disabled.

A misdiagnosis can be catastrophic because it can provide a false reassurance about the patient's condition and prognosis. Cauda equina syndrome can be progressive and if a misdiagnosis leads to a delay in surgery, it is possible that the patient's nerve compression and associated function losses may worsen dramatically, with little hope of recovery.

When to claim compensation

It may be possible to claim compensation if it is apparent both that a failure of diagnosis caused a delay in the medical management of the patient's condition, and that the delay led to the patient suffering symptoms and difficulties which would not have been the case with an earlier prompt diagnosis and surgery.

Where this is found to be the case, through a thorough analysis of the patient's medical records, a successful claim would address the financial losses experienced by the patient insofar as they have been caused by the negligence.

For example, if the patient is now unable to pursue their former career or is restricted in their working hours, their loss of income, both in the past and in the future, would be taken into account.

If the nature of the patient's symptoms, such as reduced mobility or bowel symptoms, require adaptations to the home or the purchase of specialist equipment, these costs could be included in a claim.
