Can I Sue The Hospital for Negligent Cauda Equina Treatment?
If hospital negligence has left you or a loved one struggling to cope, contact a specialist lawyer to discuss the possibility of making a claim for compensation.
The right to compensation for negligent medical care
If medical professionals in a hospital, or, in fact, elsewhere, are responsible for negligent care which causes the patient to suffer a poor long-term outcome, it may be appropriate to make a claim for compensation.
A successful compensation claim will address issues of the patient's pain, suffering and financial losses, such as a loss of employment and income, in so far as those losses have been caused by the negligent care.
If early investigations conclude that there has not, in fact, been a breach of duty by the relevant professionals, or that the patient's outcome has not been adversely affected, a claim for compensation would not be appropriate.
Medical care of cauda equina compression
Competent and timely care of cauda equina compression is essential if the patient is to avoid long-term symptoms of double incontinence and loss of mobility.
Medical practitioners may be regarded as having acted negligently if any of the following occur:
- Symptoms of cauda equina syndrome are not recognised, leading to a misdiagnosis and a delay in treatment
- The patient is not warned of the red flag symptoms which should prompt a return to hospital at the earliest moment
- Carrying out an MRI scan is delayed or, where facilities are not available, a delay in transferring a patient to more appropriate facilities causes a delay in diagnosis
- A delay in arranging for surgery to be carried out
Why timing matters
Timing of diagnosis and surgery is a crucial issue where cauda equina syndrome is concerned due to its progressive nature. As more time passes, the compression of the nerves can increase, causing greater loss of function. If this appalling condition is diagnosed promptly, the patient may avoid permanent disability.
If medical professionals cause an unnecessary delay in treatment, and the patient's condition deteriorates during that delay, the relevant professionals may be held responsible for the associated poor outcome.
