Can I Claim Compensation for Incontinence Due to CES?

Cauda equina syndrome is an extremely distressing condition which can cause both bladder and bowel incontinence if it does not receive prompt medical attention.

Cauda equina syndrome can develop when a disc in the lumbar region of the spine ruptures and presses on the cauda equina nerves. If this continues, it can cause the nerve function to be reduced.

One of the functions of the cauda equina nerves is to detect sensation and initiate movement in both the bladder and bowel. A loss of function, therefore, can have a range of debilitating effects:

  • Loss of bladder sensation meaning that the individual does not realise that they need to urinate
  • Leakage of urine without control (i.e. incontinence)
  • Loss of sensation around the anus and loss of awareness of the need to defecate
  • Incontinence of faeces
  • Incontinence of wind

Not only are these symptoms highly-distressing, but they may also impact significantly on an individual's daily life. The victim of this shocking condition may find themselves restricted in their capacity to work, for example. They may find that they face difficulties in many aspects of their life such as travelling, socialising and sport.

Can I Make a Compensation Claim?

If this poor, long-term outcome is considered to be the result of substandard medical care, it may be possible to make a claim for compensation.

Cauda equina syndrome needs to be diagnosed at as early a stage of progression as possible. If the early symptoms of this appalling condition are missed or misdiagnosed, the patient may not receive a referral for the MRI scan which is necessary to confirm their condition.

If surgery is consequently delayed, the patient may find that their nerve compression deteriorates and their symptoms not only worsen but may become permanent.

A delay in surgery for a patient with cauda equina syndrome can mean that a patient who might have made a good recovery faces a lifetime of disability.
