Wind Problems After Negligent Care of a Perineal Birth Tear

Negligent Birth Tear Compensation ClaimsIt may seem unlikely that an injury during vaginal childbirth can leave a woman with permanent wind incontinence but, unfortunately, this is sometimes the case. And, although wind incontinence can sound pretty innocuous, the reality is that it can significantly impact a woman's quality of life and undermine her self-confidence.

If this distressing and debilitating outcome is the result of negligent maternity care, it may be appropriate to make a claim for compensation.

Severe perineal birth tears

Severe birth tears, also referred to more precisely as 3rd and 4th degree tears, extend from the vagina across the perineum and into the anal sphincter. This means that the effectiveness of the anal muscles is damaged and, without prompt diagnosis and repair, the woman affected will develop problems with her bowel control. This may include both wind and faecal leakage.

The severity of this injury means that maternity professionals should examine a new mother for any signs of damage of this nature and ensure that it is accurately diagnosed and competently repaired.

If this doesn't happen, not only will the woman experience bowel problems, but the substandard nature of this quality of care may well justify a claim for compensation.

Making a claim for compensation

Uncontrolled wind incontinence can be extremely debilitating and, as well as making a woman reluctant to engage in social situations, may also affect the type of work she is able to do. Some areas of employment, such as education or hospitality, for example, may no longer be accessible or feel appropriate.

Consequently, the woman may need to take on a different form of work which may be less well paid and suffer a significant loss of income as a result. Where this distressing situation is the result of negligent medical care, the loss of earnings, both past and future, would be included in a successful claim.

A woman suffering with these shocking symptoms may need specialist equipment or treatment to try to cope with her symptoms and, again, the associated costs could be included in a compensation claim.
