Vaginal Childbirth Stoma and Claiming Compensation for Negligence
If you are struggling with the impact of needing a stoma due to poor-quality maternity care, contact a specialist solicitor to discuss the possibility of making a claim for compensation.
The shock of the stoma
Needing to be fitted with a stoma is not an outcome which should be expected when a woman gives birth to her baby through the vagina. However, this is an occasional and shocking result for those few women who suffer a 4th degree tear which is not adequately resolved at the time of the baby's birth.
A 4th degree tear is the most severe form of birth tear and, without competent medical attention, it can leave a woman in need of a stoma to provide bowel function.
A 4th degree tear can occur during a vaginal delivery when the pressure around the vagina becomes too intense and the skin and muscle split, spreading across the perineum, through the anal sphincter and into the lining of the anal canal. Such an extensive and severe injury must be diagnosed as soon as possible.
This requires the new mother to undergo a thorough examination and such a process should occur after the delivery of every baby through the vagina. As part of this procedure, a digital rectal examination is also required to ensure that the anal sphincter is intact.
Long-term consequences
A failure to carry out such an examination or a failure of diagnosis or repair, could leave a woman suffering this appalling and permanent outcome.
Coming to terms with the need for a stoma and adapting one's life to the requirement to manage it can be extremely difficult and, where medical negligence has played a part in this distressing outcome, a successful claim can help to address some of the financial and emotional consequences.
For example, if the new mother is now unable to work or is restricted in her ability to work because of the impact of her symptoms, the associated loss of earnings would be incorporated into a successful claim along with other financial losses, such as the cost of hygiene equipment, which has been caused by the negligent care.
