Vaginal Childbirth and Claiming Compensation for Medical Negligence
If negligent medical care during vaginal childbirth has left you with permanent bowel problems, contact Glynns to discuss a claim for compensation.
Severe perineal tears and vaginal childbirth
The physical pressure of vaginal childbirth on the area of the perineum puts a woman at risk of suffering a perineal tear. In fact, around 5% to 10% of women who give birth through the vagina experience what is referred to as a severe perineal tear.
A severe perineal tear is one that causes more significant damage than a 1st or 2nd degree tear. Severe tears, also known as OASI or 3rd and 4th degree tears cause damage to the anal sphincter. In doing so, they affect a woman's ability to control the passing of wind and faeces. Unless these injuries are promptly and effectively repaired, a woman may find that she suffers leakage, or incontinence, of wind or faeces, or both.
In the case of a 4th degree tear and the development of a fistula, a new mother may find that she is unexpectedly experiencing leakage of wind or faeces from her vagina. It is an appalling outcome of childbirth which nobody anticipates and which can affect a woman's capacity to care for and support her new baby.
As well as the appalling distress which such symptoms inevitably cause, these injuries can lead to a loss of income if the new mother is no longer able to return to her former employment because of her appalling symptoms.
Competent medical maternity care should minimise the risk of these tears and accurately diagnose and repair them when they do occur. If this does not happen, the relevant medical professionals may be regarded as having been negligent in their care of the new mother. This may justify a claim for compensation.
