When is a third degree tear negligent?

Third and fourth degree tears are a risk of vaginal childbirth, especially if you have undergone an instrumental delivery or are giving birth for the first time.

They can cause appalling and long-term bowel problems. It is crucial, therefore, that they receive prompt, accurate and effective medical care. However, a failure of care does occasionally occur, leaving a new mother to face a lifetime of leakage, urgency and incontinence which can compromise her quality of life, impact on her ability to bring up her baby and restrict her capacity to work.

The following medical failings may be regarded as negligent:

  • A failure to examine a new mother following vaginal childbirth, including a failure to carry out a digital rectal examination for anal damage
  • A failure to identify damage to the anal sphincter
  • A misdiagnosis of damage to the anal sphincter
  • A failure to carry out an effective repair

If a woman suffers on-going bowel symptoms due to negligent medical care, such as the above, it may be possible to make a claim for compensation.

How to claim compensation
