Severe Vaginal Childbirth Tear Compensation

What is a severe vaginal childbirth tear?

Vaginal childbirth tears are injuries which occur to the mother's vagina, perineum and, sometimes, to the anal sphincter as her baby is born. Most birth tears would not be categorised as severe. Thankfully, only a minority of women suffer what are regarded as severe tears. These injuries are also referred to as 3rd and 4th degree tears or OASI (obstetric anal sphincter injuries).

Severe tears are those which extend into the anal sphincter, the muscles around the anus which control the passing of wind and faeces. Third degree tears damage the external and, sometimes, the internal anal muscles whereas 4th degree tears additionally cause damage to the lining of the anal canal.

The greater the extent of the injury, the worse symptoms the new mother is likely to experience.

Prompt and accurate diagnosis of any injury is necessary followed by a competent, effective and full repair.

When Can I Claim Compensation?

A patient is entitled to claim compensation when negligent medical care causes them to suffer symptoms which they would not have suffered with competent and acceptable care. In the case of severe birth tears, this mostly applies to the quality of the diagnosis and repair.

If an injury is not diagnosed, it will not receive a repair. If only part of a severe birth tear is diagnosed, the new mother may still suffer problems with her bowel function if part of an injury is left unrepaired.

If a severe 3rd or 4th degree tear is not repaired effectively, the new mother may continue to suffer symptoms which she would not have experienced had she received a full and effective repair.
