Severe Perineal Tear Maternity Negligence

Negligent care of trauma to the perineum during childbirth can leave the new mother with permanent disability and may justify a claim for compensation.

Perineal trauma

Not all perineal trauma during vaginal childbirth is considered to be 'severe'. First and second degree tears affect the skin and muscle of the vagina and perineum but tend to repair effectively and fairly promptly. They may need some stitching by a midwife in the maternity suite.

The term 'severe tears' refers to third and fourth degree tears caused by the pressure around the vagina during the process of giving birth.

Third and fourth degree tears are more significant injuries because they additionally damage the anal sphincter. This is the muscles which control the bowel and, if they are damaged during childbirth, the new mother risks losing control of her bowel. This means that she may experience loss of her ability to prevent the passing of wind and faeces. In effect, she may become incontinent.

Perineal care on the maternity ward

Consequently, any damage to the perineum which may involve the anal sphincter around the anus must be identified and accurately classified as soon as possible after the birth. This will enable a thorough repair to be undertaken, which needs to happen in an operating theatre and should be carried out by an experienced surgeon.

  • A failure to recognise that the anal muscles have been damaged may be regarded as negligent
  • A misdiagnosis of any anal damage may also be regarded as negligent
  • A failure to execute a thorough and competent repair of any anal damage could be regarded as negligent

A delay in diagnosis and repair may mean that any future attempt to restore function will be less successful, leaving the woman with permanent bowel problems.

The impact of such problems can be severe, depending on the degree of damage and the extent of symptoms. In terms of work alone, double incontinence may restrict a woman's capacity to work in any form of employment which requires interaction with the public such as education, care work, hospitality, retail and law enforcement.
