Perineal Tear Trauma and When to Claim Compensation

Negligent Birth Tear Compensation ClaimsIf ongoing symptoms of a severe perineal tear have been caused by substandard maternity care, speak to a legal specialist about the possibility of claiming compensation.

Severe perineal tears

We often find that the trauma of a severe perineal birth tear is not restricted to physical difficulties but can cause significant emotional stress also. The psychological shock of finding herself struggling to cope with incontinence of both wind and faeces or, as in some cases, coming to terms with having a stoma fitted, can be disabling to a new mother.

Although only a minority of women suffer severe perineal tears during vaginal childbirth, when those injuries pass unrecognised and unrepaired, the impact can be life changing.

Third and fourth degree tears, which cause damage to the muscles around the anus which control the passing of wind and faeces, require prompt diagnosis shortly after the birth of the baby. A misdiagnosis or a complete failure of diagnosis can leave the new mother with on-going symptoms, sometimes even struggling to leave her home due to both the practical and emotional difficulties associated with her symptoms.

When to claim compensation

The law allows that, when an individual suffers as a result of negligent or substandard medical care, they are entitled to claim compensation for the consequences of that negligence.

If you suspect that the symptoms and difficulties you are struggling with every day are a result of negligent maternity care, you should speak to a legal specialist about the possibility of claiming compensation.

If it seems appropriate, they will obtain copies of your medical records and engage medical experts to analyse the quality of your care. If it appears that you have, indeed, been the victim of negligence, they will support you in pursuing a claim for compensation.

A successful claim will address the difficulties which the negligence has caused you. This could include any loss of earnings which you have experienced and will experience in the future plus any additional costs which are the result of the symptoms which you are experiencing, such as additional treatment or equipment or care.
