Negligent birth tear repair
If a woman suffers a severe birth tear, a 3rd or 4th degree tear, during vaginal childbirth, an accurate diagnosis will probably ensure an effective surgical repair. She may be symptom-free within a year of the birth.
Occasionally, however, although the woman has received a diagnosis, the repair of the damage to her anal sphincter may not be sufficiently competent to ensure recovery.
The damage caused by a severe perineal and anal tear during vaginal childbirth can be extensive and complex and requires the attention of a skilled surgeon to achieve an effective repair.
If the repair is substandard in some aspect, the woman may find that she continues to experience distressing and debilitating symptoms of the remainder of her life.
A surgical repair for a severe tear, sometimes referred to as an obstetric anal sphincter injury (OASI), may fail for a number of reasons:
- The full extent of the injury may not be resolved during surgery, leaving part of the damage to cause on-going symptoms. The remaining wound may break down further, leaving the woman with a fistula between her anus and her vagina
- The appropriate and recommended techniques for the repair may not be used , resulting in an inadequate repair and on-going symptoms
- The appropriate and recommended materials may not be used for the repair, perhaps allowing it to break down, meaning that the woman may continue to suffer symptoms of wind and faecal incontinence, or extreme urgency when needing to got to the toilet.
