Medical Negligence and OASI Compensation
Negligent medical care in relation to vaginal childbirth can leave a new mother with permanent and disabling bowel symptoms. Contact Glynns to discuss the possibility of making a claim for compensation.
The right to claim compensation
If you have suffered on-going and debilitating symptoms because of substandard medical care, you are entitled, by law, to make a claim for compensation for the impact which the negligence has caused.
OASI symptoms and quality of life
An OASI is a severe perineal tear, causing distressing bowel symptoms and requiring prompt and skilled medical attention.
The vast majority of perineal tears during childbirth are fairly small and recovery does not take long.
A small percentage of perineal tears, however, are more severe. OASI (obstetric anal sphincter injuries) extend beyond the range of 1st and 2nd degree tears and cause damage to the muscles which control bowel movement.
An OASI is classified according to whether it damages just the external anal sphincter or both external and internal sphincter. A 4th degree tear will additionally cause damage to the anal canal.
If a woman is unfortunate enough to suffer an OASI during the birth of her baby, she requires a complete and effective repair in order to minimise its impact.
If this does not occur, she may suffer appalling and permanent bowel problems which can impact almost every aspect of her life from her capacity to work to the quality of her personal relationships.
Medical negligence
Failing to provide effective care of an OASI may be regarded as negligent and may justify a claim for compensation.
Unfortunately, examples of negligent medical care in relation to this traumatic injury can occur in a number of ways including the following:
- A failure to carry out a thorough examination following the birth of the baby
- A failure to identify all damage correctly
- A misdiagnosis of a perineal or anal injury
- A failure to carry out an effective and complete repair
