A 3rd degree tear is a severe form of perineal tear which can sometimes occur during vaginal childbirth. Whereas most tears affect only the sink and muscle of the vagina and the perineum, a 3rd degree tear causes far more serious damage. Extending beyond the perineum a 3rd degree tear injures the muscles of the anus which control the passing of wind and faeces.

It is essential that a 3rd degree tear is precisely and accurately diagnosed. Third degree tears vary in extent and severity and, along with 4th degree tears need to be recorded appropriately so that an effective repair can be carried outby an experienced surgeon.

Negligent maternity care in relation to severe birth tears may include the following:

  • A failure to carry out a thorough examination following the birth of a baby. This should include a digital rectal examination to assess the condition of the anal muscles.
  • A failure to identify any damage which has occurred to the anal sphincter
  • A misdiagnosis of damage to the anal sphincter such as diagnosing a 3c tear as a lesser 3a tear.
  • A failure to carry out an appropriate, effective and comprehensive repair
