Long Term Bowel Symptoms and Negligent Perineal Tear Compensation

If you are experiencing on-going severe bowel problems after the vaginal birth of your baby, you may have an undiagnosed severe birth tear. It may be possible to claim compensation.

Symptoms of an unrepaired severe birth tear

A failure by medical professionals to provide appropriate and effective care of a severe perineal and anal birth tear can leave a woman with appalling symptoms as follows:

  • the loss of her ability to prevent the passing of wind when she chooses
  • the loss of her ability to prevent the passing of faeces when she chooses
  • extreme urgency when needing to go to the toilet
  • repeated perineal infections
  • perineal discomfort

The severity of the symptoms will vary from one woman to another. Indeed, the vast majority of women do not suffer a severe birth tear during childbirth and, for many of those who do, the quality of their care results in recovery from symptoms. When this does not occur, however, the practical, psychological and financial implications can be life-changing.

Negligent perineal and anal medical care

Medical professionals attending a vaginal birth have a duty to ensure that any injury to the new mother is diagnosed and repaired appropriately.

A thorough examination, including a digital rectal examination of the new mother, is essential in order to ensure that an damage to the anal sphincter is identified. Once any damage has been observed, an accurate diagnosis is necessary in accordance with the classification guidelines of the Royal College of Obstetricians and Gynaecologists.

A failure to carry this out will result in a failure to repair the damage, leaving the new mother with debilitating symptoms.

Occasionally, despite an accurate diagnosis, the quality of the repair is substandard, allowing the repair to break down and symptoms to develop.

Claiming compensation

If negligent medical care has caused an individual to suffer a worse outcome than would have been the case with an acceptable level of care, the patient is legally entitled to make a claim for compensation.

A successful compensation claim would incorporate any financial losses experienced, and to be experienced in the future, by the woman affected. This may include a loss of income for example. This only applies in so far as the financial losses have been caused by negligent care.
