How to Make a Claim for a Negligent OASI

How to Make a Claim for a Negligent OASIIf you have suffered an obstetric anal sphincter injury during the birth of your baby and continue to suffer life-changing symptoms, it may be that you have not received the correct medical care and it may be possible to make a claim for compensation.

What's an OASI?

An OASI is a severe tear which occasionally occurs during vaginal childbirth. The tear spreads from the vagina and, as the name suggests, damages the muscles around the anus. These muscles are crucial to a woman's control over the passing of wind and faeces and if they are damaged, and remain undiagnosed or unrepaired, their function is reduced and the woman starts to suffer incontinence problems.

An OASI requires meticulous and competent medical care. Without this, the new mother may struggle with incontinence of both wind and faeces, as well as issues of urgency and discomfort, not to mention the psychological impact of severe bowel problems.

When to make a claim

If you are experiencing significant problems which you know, or suspect, to be the result of negligent care, you may be able to make a claim. Negligent care may refer to a failure of examination, a failure of diagnosis or a failure of repair.

The best advice is to speak with a legal specialist at the earliest possible moment. This will allow an investigation into the quality of your care to be carried out before the deadline for such claims, which is three years from the date of the alleged negligence.

How to make a claim

In the first instance, it is necessary for your specialist solicitor to establish whether or not an act of negligence has occurred during the course of your maternity care. They will want you to describe your recollection of events and support you in drafting a witness statement. With your authorisation, they will also obtain a copy of your medical records and use the best medical experts to assess the quality of care which you received.

If it is found that you have, indeed, suffered from negligent care, a further assessment of the ways in which the negligence has affected you will be made.

Using a solicitor who specialises in medical negligence law will provide you with expertise in this highly complex area of law, ensuring that you meet all necessary deadlines and comply with all legal requirements.
