How to Challenge 3rd Degree Tear Maternity Negligence

Negligent Birth Tear Compensation ClaimsIf you are struggling with distressing bowel problems following the birth of your baby, it may be that you suffered an anal tear during the birth which has not been diagnosed.

3rd and 4th degree tears

A 3rd or 4th degree tear during vaginal childbirth can cause permanent and highly-distressing problems including leakage or incontinence of both wind and faeces. Although these appalling injuries are a known risk of vaginal childbirth, especially for first-time mothers, they are occasionally overlooked.

According to the guidelines of a Royal College of Obstetricians and Gynaecologists, all women who give birth through the vagina should undergo a digital rectal examination following the birth of their baby to check for the condition of the anal muscles.

If this does not take place, a 3rd or 4th degree tear will not be identified and a repair will not take place.

If an examination is carried out, it is essential that the full extent of the injury is recorded to ensure that a full repair is carried out.

A failure of examination, a failure of diagnosis or a misdiagnosis can all mean that the new mother is left with an injury which can be life-changing.

Challenging your care

If you suspect that you have an undiagnosed anal tear, speak to a specialist solicitor.

They will be able to obtain copies of your medical records and arrange medical appointments for you with the best medical experts to identify if you have been the victim of negligence.

If it is found that your maternity care was substandard, your specialist solicitor will assess its impact on you and the associated financial losses such as a loss of income if you are now struggling to work.

Speaking to a solicitor

Not surprisingly, women who are struggling with an unrepaired 3rd or 4th degree tear often find their condition and symptoms very difficult to talk about. They may feel embarrassed by their symptoms and sometimes even struggle to leave their home because of their fear of bowel accidents.

A specialist solicitor who deals daily with severe medical negligence cases will fully understand the problems and symptoms which you may be experiencing and will deal with your case with sensitivity.

They will understand the many ways in which your daily quality of life may be affected by your distressing symptoms and they will ensure that your financial losses are comprehensively recognised.
