Forceps Delivery Negligence and Claiming Compensation

Instrumental deliveries and severe tears
An instrumental delivery with forceps or ventouse is a risk factor for a severe perineal tear. The risk is increased with forceps where the pressure on the vagina and perineum is greater and an extended tear may result.
Medical negligence is relation to a forceps delivery, resulting in damage to the anal muscles may occur in a number of ways:
- If the decision is made to carry out an instrumental delivery, it is recommended that a medio-lateral episiotomy is carried out first. This should reduce the risk of a severe tear. If an episiotomy is not carried out or an inappropriate form of cut is made, the relevant medical professionals may be regarded as having provided substandard care
- If a severe perineal tear, either a 3rd or 4th degree tear does occur, the medical professionals attendant at the birth are responsible for identifying and diagnosing the injury accurately. This would require a thorough examination of the perineum including a digital rectal examination. All damage, including any damage to the external and internal anal muscles should be diagnosed and recorded.
- If a severe tear has occurred, a prompt, full and effective repair by an experienced surgeon is absolutely essential in order to prevent the new mother from suffering permanent bowel problems.
Anal sphincter damage
A 3rd or 4th degree tear is one which extends beyond the vagina and the perineum and causes damage to the muscles which control and prevent bowel movement.
Without an appropriate repair, the new mother may suffer incontinence of both wind and faeces as well as urgency when needing to go to the toilet. She may also suffer infections, discomfort and psychological damage due to the unexpected and shocking nature of her symptoms.
Severe bowel problems may affect her capacity to work and restrict the nature of employment she can undertake.
If this situation is the result of negligent maternity care, it may be appropriate to make a claim for the impact such as the loss of income.
