Financial Losses and Compensation for Negligent 3rd Degree Tear Care

Financial Losses and Compensation for Negligent 3rd Degree Tear Care

If an individual suffers significant financial losses due to negligent medical care, they are legally entitled to claim compensation. Contact Glynns Solicitors to speak with a legal specialist.

Third degree tear negligence

The consequences of negligent care of a third degree tear can be life-changing, causing both a loss of income on the one hand and sometimes necessitating increased expenditure on the other.

A third degree tear in vaginal childbirth is a tear which extends from the vagina, across the perineum and into the anal sphincter, the muscles which control bowel movement.

The anal sphincter involves both external and internal muscles and third degree tears are classified according to the extent of the damage they cause. They may only cause injury to the external muscle or they may tear through the external muscle additionally damaging the internal muscle.

All forms of 3rd degree tear can cause severe bowel symptoms. However, it is crucial that the injury is correctly identified as either a 3a, 3b or 3c tear in order to ensure that a full repair takes place. For example, if a 3c tear, which affects the internal muscle, is mistakenly diagnosed as a 3a tear, which does not, the damage to the internal muscle may remain unrepaired, thereby allowing the woman to experience bowel problems despite the fact that a repair of sorts has taken place.

Negligent care of a 3rd degree tear could include the following:

  • A failure to carry out an examination
  • A failure to diagnose damage to the anal sphincter
  • A misdiagnosis of damage to the anal sphincter
  • A failure of a repair to severe perineal and anal damage

Financial losses due to 3rd degree tear damage

The impact of damage to the anal muscles, leaving a woman with bowel leakage or incontinence can be wide-ranging.

The practical issues associated with managing bowel incontinence can mean that a woman is unable to continue to pursue the career or employment that she had enjoyed prior to the delivery of her baby.

In some circumstances, this can cause a significant drop in income.

The psychological impact of bowel incontinence can also affect a woman's self-confidence and capacity to work.

Financial losses which are considered to be the result of negligent maternity care can be included in a successful compensation claim.
