Faecal Leakage Due to Childbirth Negligence

What causes faecal leakage?

If you are experiencing faecal leakage, unintended passing of poo, following the birth of your baby, it is possible that you suffered a severe tear during labour which was not diagnosed or repaired.

Perineal tears, which sometimes occur during childbirth, cross the perineum and, at their worst, cause damage to the muscles around the anus which control bowel movements. These are referred to more commonly as 3rd or 4th degree tears.

Such injuries need to be diagnosed promptly following the baby's birth to ensure that they are surgically repaired. If diagnosis does not happen, a repair will not take place and, unfortunately, these shocking injuries can leave the new mother with loss of control of her bowel. This can lead to uncontrolled passing of wind and faeces.

The right to compensation

If an individual suffers a poor long-term outcome due to the substandard quality of their medical care, they are legally entitled to claim compensation for the consequences of that negligence.

Where 3rd and 4th degree tears are concerned, the long-term impact of permanent bowel problems can be significant, affecting a woman both physically and psychologically. It may easily compromise her ability to work, both in terms of the hours she can manage, the locations in which she can work due to the need for access to a toilet, and the types of work she can undertake. Some forms of employment may no longer be possible such as policing, hospitality, retail and education.

A woman with an unrepaired severe birth tear may require on-going treatment or equipment to help her manage her symptoms and, if her difficulties have been caused by negligent maternity care, the associated costs could be included in a successful compensation claim.
