Compensation for Missed Maternal Birth Tear

Compensation for Missed Maternal Birth Tear

If your severe birth tear was missed by the medical practitioners who assisted at the birth of your baby, you may suffer permanent bowel problems. Contact Glynns Solicitors to discuss the possibility of making a claim for compensation.

Maternal birth tears

A maternal birth tear is an injury which frequently occurs during vaginal childbirth. As the baby is born, the skin and muscle around the vagina and perineum is torn. Maternal birth tears, or perineal tears, vary in extent and severity and it is important that the medical professionals attending the birth assess the new mother carefully and fully to ensure that any damage is diagnosed.

If the new mother has suffered a 1st or 2nd degree tear, it is likely that their injury will heal promptly but, if the injury is more severe, a skilled surgical repair is essential to avoid a lifetime of incontinence.

Third and fourth degree tears damage a woman's ability to control and prevent the passing of wind and faeces. Damage of this severity requires immediate medical attention.

Diagnosis of severe maternal birth tears

Third and fourth degree tears cause damage to the muscles around the anus. As the tear becomes more extensive, a greater degree of damage is caused including, where a 4th degree tear is concerned, damage to the lining of the anal canal. This puts the new mother at the additional risk of developing fistula or hole between her rectum and her vagina which can allow wind and faeces to leak from one to the other.

Diagnosis should be achieved as soon after the baby's birth as possible. It requires the relevant medical professional to carry out a thorough examination, including a digital rectal examination, to ensure that any and all damage is correctly diagnosed.

If a severe maternal birth injury is missed, it can leave a woman with long-term symptoms of bowel urgency or incontinence.

Claiming compensation

If a woman suffers on-going symptoms due to substandard medical care, she may find that her confidence suffers and her ability to work is compromised due to her appalling bowel symptoms.

In these circumstances, it may be appropriate to make a claim for compensation for the financial losses caused by the impact of the negligence.
