Compensation for Birth Tear Incontinence
A severe birth tear during childbirth can cause incontinence. Competent and timely maternity care should prevent this but substandard care may leave a new mother reeling from the appalling consequences of this distressing condition. Speak to a specialist solicitor to find out about the possibility of compensation.
Substandard maternity care of a birth tear
If you are suffering from incontinence of wind and faeces or urgency following the birth of your baby, you may wondering what has gone wrong and what you can do about it. Perineal tears during vaginal childbirth are common but severe tears should be picked up by maternity staff at the time and repaired by an experienced and suitably-qualified surgeon to ensure recovery from symptoms.
Substandard care which might mane that diagnosis and repair are delayed and less likely to be successful could include the following:
- A failure to carry out a thorough examination which should, according to the Royal College of Obstetricians and Gynaecologists, include a digital rectal examination
- A failure to identify that an injury has occurred
- A misdiagnosis of an injury such as diagnosing a 3rd degree tear as a 2nd degree tear or mis-identifying a 3c tear as a 3a tear
- A failure to carry out an effective repair, allowing symptoms to continue
The right to compensation
If a woman suffers long-term symptoms following substandard or negligent maternity care, she is legally entitled to claim compensation for the consequences of that negligence.
If her bowel symptoms are debilitating, as they often are, the new mother may struggle to return to work as planned or may be restricted in the type of employment she can undertake. Working in education, hospitality, healthcare or retail, for example, may now be problematic. If this causes the woman to suffer a loss of income, this financial loss, both now and in the future, would be included in a successful claim.
Any other financial costs or losses can also be included in a claim insofar as they have been caused by negligent medical care.
