Claiming Compensation for a 3c Birth Tear

Claiming Compensation for a 3c Birth Tear

Negligent care of an anal sphincter injury during childbirth might justify a claim for compensation. Contact Glynns Solicitors if you are suffering from this appalling injury due to poor-quality medical care.

What is a 3c birth tear?

A 3c birth tear is a type of third degree anal tear which can sometimes occur during vaginal childbirth. Third degree tears are severe injuries which can cause significant damage to the bowel. Occurring as the baby is born and due to the pressure on the skin and muscle around the vagina, a 3c tear cuts across the perineum, through the external anal sphincter muscle and into the internal anal sphincter muscle.

Medical negligence

Due to the severity of both the injury and the potential long-term symptoms, medical practitioners attending the birth should examine the new mother meticulously for any signs of anal damage.

A failure to do so is likely to result in no diagnosis or a misdiagnosis and a failure to repair what might be a very serious injury.

Such poor-quality care may be regarded as negligent.

Long-term impact of a 3c tear

If damage to the anal sphincter muscles is not repaired promptly after the birth of a baby, the new mother may suffer appalling and debilitating symptoms for the rest of her life.

Symptoms associated with this type of injury would include perineal discomfort, incontinence of wind , incontinence of faeces and perineal infections.

Not only do such symptoms cause significant practical difficulties in terms of hygiene and access to a toilet, but they can impact on many areas of life, including causing significant emotional distress.

Many areas of employment may no longer be accessible to a woman with faecal or wind incontinence and this can cause a reduction in income as well as self-esteem. Social and personal relationships can suffer, leading to social isolation and depression.

Symptoms may even worsen as a woman ages.

Making a compensation claim

A successful compensation claim can provide a sense that justice has been done as well as providing financial recompense for the impact. If you have suffered a reduction in your income due to the effects of a misdiagnosed tear, a claim should take these losses into consideration.

However, compensation claims for medical negligence are extremely complex so it is advisable to get the support of a specialist medical negligence solicitor.

Remember also that claims for medical negligence have to be initiated within three years of the date on which the negligence occurred.
