Claim Compensation for Negligent Birth Tear Bowel Problems.

Claim Compensation for Negligent Birth Tear Bowel ProblemsIf you are struggling with distressing bowel symptoms because your maternity care was inadequate, speak to a specialist solicitor about the possibility of making a claim for compensation.

Negligent birth tear problems

A severe birth tear, otherwise known as a 3rd or 4th degree tear, needs to be dealt with as soon as possible after the birth of the baby. Occasionally this does not happen and the new mother finds that she is experiencing significant and extremely distressing problems with control of her bowel. The impact which this can have on the woman's quality of life and her ability to bond with and support her new baby can be devastating. If medical professionals failed to provide adequate and appropriate post-natal care, leaving the new mother to cope with such a shocking outcome, it may be possible to claim compensation for the consequences.

What does this mean?

It means that if, for example, you are now unable to work or are restricted in the type of work or hours which you can manage, because of your bowel symptoms, the income which you have lost, and will lose in the future, could be included in a successful claim.

Furthermore, if you now need treatment or you need to buy specialist products to deal with your bowel symptoms, the cost of this can be included in a claim.

Medical negligence and severe birth tears

Your medical care may be regarded as negligent for a number of reasons:

  • You underwent an instrumental birth but an episiotomy was not carried out beforehand to reduce the risk of a severe tear
  • You did not undergo a thorough examination following the birth of your baby, meaning that your anal injury was not spotted
  • Your birth tear was not diagnosed or was misdiagnosed, meaning that you did not undergo a repair
  • Your repair was inappropriate or incomplete, meaning that you continue to suffer bowel problems such as urgency, leakage and incontinence. You may even need a stoma to cope with the impact of your birth tear
