Childbirth Perineal Tearing and When to Claim Compensation
Damage to the perineum and anal sphincter during vaginal childbirth may justify a claim for compensation if medical professionals have failed in their duty of care.
Perineal tear damage
A tear around the vagina and into the perineum is, unfortunately, a risk of vaginal childbirth. However, because medical professionals attending the birth should be aware of these possible injuries, they should always check the condition of the new mother's perineum after she has given birth to her baby.
This is particularly important because, for a minority of women, the tear does not restrict itself to the perineum but continues into the anal sphincter where it can cause severe and permanent bowel symptoms.
A post-natal examination of the perineum is crucial to the diagnosis of these severe tears. Any examination should include a digital rectal examination to ensure that the condition of the anal sphincter is assessed.
Without assessment, diagnosis and repair, the new mother may be left with permanent, disabling and deeply distressing symptoms including the possibility of incontinence of both wind and faeces.
When to claim compensation
It may be possible to claim compensation if the mother suffers on-going symptoms because the medical care of her severe tear, i.e. a 3rd or 4th degree tear, was in some way substandard.
Examples of substandard medical care which might result in symptoms which should have been resolved with competent and appropriate care could include the following:
- A failure to carry out an examination which includes a digital rectal examination
- A failure to identify that damage has been done to the anal sphincter
- A misdiagnosis of damage to the anal sphincter
- A substandard repair of damage to the anal sphincter
