Birth Tear Symptoms and When to Claim Compensation

Negligent Birth Tear Compensation ClaimsIf you are struggling with distressing bowel problems following the birth of your baby, it is possible that you have suffered a severe birth tear which has not been diagnosed or repaired. Speak to a medical negligence solicitor about making a claim.

3rd and 4th degree tears in childbirth

The symptoms of a 3rd or 4th degree tear can include the following:

  • Loss of control of the passing of wind, leading to uncontrolled leakage
  • Loss of control of the passing of faeces, leading to uncontrolled leakage
  • Passing wind or faeces from the vagina
  • Perineal discomfort and infections

Symptoms such as these are not normal long-term effects of vaginal childbirth and may suggest a problem.

If you gave birth through the vagina, you may have suffered a tear. Severe birth tears (3rd and 4th degree tears) which damage your anal muscles, are a risk of vaginal childbirth.

Many women suffer a small tear during childbirth but 3rd and 4th degree tears are much more severe, causing damage to the muscles around the anus.

Maternity care and maternity negligence

In order to ensure that a new mother does not suffer these shocking symptoms into the future, it is essential that maternity professionals present at the birth examine the new mother for any signs of damage. Such as assessment should include a digital rectal examination and an accurate diagnosis of any damage.

If this does not occur, the new mother may go home with an undiagnosed injury and unwanted bowel problems.

If this does occur, it may be regarded as negligent and may justify a claim for compensation.

Claiming compensation for the impact of bowel symptoms

If you are unfortunate enough to have an unrepaired 3rd or 4th degree tear, you may be struggling to manage symptoms of wind and faecal leakage. This can be extremely distressing, affecting your ability to work, undermining your confidence, limiting the activities which you can manage and demanding your attention throughout the day.

The psychological impact can be severe.

If it is found that your maternity care was negligent and that you have, indeed, been left with an unrepaired tear, a successful compensation claim would include the financial losses and costs which you may now suffer.

This could include a loss of earnings if you are struggling to work and the costs of equipment, treatment and support where this is required.
