A 3rd Degree Birth Injury and When to Claim Compensation
If you are struggling with the shocking symptoms of a 3rd degree tear after the birth of your baby, it might be appropriate to make a claim for compensation.
What is a 3rd degree birth injury?
3rd degree tears are a risk of vaginal childbirth. They can occur when the delivery of the baby puts such pressure on the vagina and perineum that a tear develops. In most cases, this injury is restricted to the perineum, the region between the vagina and the anus but, occasionally, the tear extends beyond this region and the muscles around the anus are damaged. Unfortunately, this type of injury affects the function of those muscles and can mean that the woman then struggles to control the passing of wind and faeces.
It is important to reiterate that such a severe injury does not occur to every woman who gives birth in this way. Also, for the majority who do experience these awful injuries, prompt medical care usually ensures that the injury is competently repaired and the new mother's symptoms are resolve.
Occasionally, however, the presence of a tear is missed and the new mother does not receive a repair. The resulting symptoms can be life-changing.
Compensating for the symptoms of negligence
The symptoms associated with 3rd degree tears include the loss of control of the passing of wind and faeces.
Occasionally, a woman suffers a more severe 4th degree tear which can cause leakage from the vagina and may require the fitting of a stoma.
Where negligence is established, such as a failure to carry out an examination or a misdiagnosis of an injury, a successful compensation claim will address the financial impact which the woman's symptoms are having on her life.
For example, she may now struggle to work or be restricted in the type of work she can manage. If so, the loss of income, both past and future, would be included in the claim.
Equally, if the new mother requires specialist treatment or equipment in order to manage her symptoms, the associated costs would be included in her claim.
