3rd Degree Tear Maternity Care and Medical Negligence Claims.
Speak to Glynns Solicitors is you suspect that you are suffering the effects of an undiagnosed 3rd degree tear.
What is a 3rd degree tear in childbirth?
Due to the pressure of the baby passing through the vaginal opening, the new mother's perineum sometimes splits and a tear develops. This may be superficial and easily resolved. It may need minimal medical attention.
However, occasionally, especially in particular circumstances, a far more serious injury can develop and the tear may extend beyond the perineum and into the anal muscles which control the passing of wind and faeces. It may even extend into the anal canal and put the new mother at risk of developing a fistula, or hole, between the rectum and the vagina.
Such a distressing injury is most likely to happen when a woman is undergoing an instrumental delivery, when she is a first-time mother or when she is giving birth to a large baby.
Maternity care of a severe tear
Unrepaired, a severe birth tear will leave the new mother facing a lifetime of bowel problems including loss of control of the passing of wind and faeces.
Maternity professionals have a duty, therefore, to provide the best level of care to ensure that, if such injuries do occur, they are diagnosed and effectively repaired shortly after the birth of the baby. Any significant delay in diagnosis and repair may undermine the possibility of recovery.
A failure of examination, diagnosis or repair may all be regarded as negligent and may justify a claim for compensation.
Claiming compensation
Significant bowel symptoms of wind and faecal leakage can restrict a woman's capacity to work and undermine her confidence, further limiting what she feels able to do. A need for quick and easy access to toilet facilities can become the overwhelming focus of a woman's day and, where this is not possible, can restrict almost every aspect of her life.
A successful claim for compensation can help to address may of the problems arising from this situation such as a loss of income due to employment difficulties and restrictions.
The new mother may also need specialist treatment or equipment in order to manage her bowel problems, the costs of which can be incorporated into a claim.
