3rd Degree Tear – Compensation Amounts
If your 3rd degree tear claim is successful, you will be awarded compensation. How much you are likely to receive will depend upon your individual circumstances.
How much compensation for 3rd degree tear?
It is not possible to say at the start of a claim exactly how much compensation you will receive. Your solicitor may be able to give you a rough idea, but it will not be until the claim has been fully investigated that your compensation settlement can be properly determined.
To help you understand how much you could stand to receive, it is useful to know that compensation settlements are made up of general damages and special damages.
General damages reflect your physical and emotional pain and suffering, and your loss of amenity (meaning your quality of life). Your legal team will assess your general damages, using your medical reports to establish the severity of your injuries. These will then be compared against legal guidelines for general damages, which suggest how much you should be awarded.
The worse your condition is, the higher the general damages will be. For instance, if you have been left with a colostomy, the general damages will be higher than if you have been left with mild faecal urgency.
Special damages reflect your actual financial loss. This covers both past financial losses and future financial losses. It may be that you will not be able to return to work when your maternity leave ends. Your future loss of earnings will be included in your settlement, as will others things such as your loss of pension, the cost of incontinence pads and the cost of medical treatment.
Your special damages will be calculated by your solicitor in a Schedule of Special Damages. The greater your financial loss, the greater your special damages will be.
This gives you an idea of how your compensation settlement is determined. For a fuller picture, you could always take a look at the 'settled claims' section on our website. This provides examples of 3rd degree tear cases we have settled, including details of compensation awards.
