3c Birth Tear Misdiagnosis and When to Claim Compensation

3c Birth Tear Misdiagnosis and When to Claim CompensationIf your bowel symptoms are being caused by failings during the vaginal birth of your baby, it may be possible to claim compensation.

3c tear misdiagnosis

Misdiagnosis of a 3c birth tear can leave a new mother with appalling physical and psychological symptoms. If negligent maternity care has contributed to this distressing outcome, contact a legal specialist to discuss the possibility of making a claim for compensation.

A 3c tear is a severe form of birth tear. Most women suffer a perineal tear of some form when giving birth vaginally but for the vast majority this is restricted to the perineal area between the vagina and the anus.

A 3c tear is a far more significant injury in that it additionally cuts through the external anal sphincter and damages the internal anal muscle. The anal sphincter muscles work in combination to control the passing of wind and faeces and damage to the muscles will inevitably compromise a woman's bowel function.

A failure by maternity staff to diagnose this appalling injury correctly or a failure to carry out an effective repair may be regarded as negligent and may justify a claim for compensation for what may be life-changing consequences.

Even a misdiagnosis of a 3c tear as a 3a tear may leave the woman suffering symptoms which may not have been the case with an accurate diagnosis.

When to claim compensation

In order for a claim to be successful it must be clear that the woman affected suffered some form of negligence during the course of their care. It must also be the case that any negligence affected her long-term outcome adversely.

In these circumstances, it may be possible to make a claim which would address the financial consequences of the negligence such as loss of income.

Examples of negligence could include a failure to carry out an examination of the new mother's perineum including a digital rectal examination after the birth of the baby. It would also include a failure to diagnose or a misdiagnosis, leading to a lack of repair or an inadequate repair.
